Employer fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     An employer was fined $10,000 at the Kwun Tong Magistrates' Courts today (March 16), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     The defendant, Ascent Union Limited trading as Bella Delon, was charged for an offence under section 7(1) of the ordinance. The defendant was found guilty on a count of failing to enrol one employee in MPF schemes as required by the ordinance and was fined $10,000 for the summons.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) pursued two claims in the Small Claims Tribunal for some $37,000 on behalf of two employees, who were owed MPF contributions by their employers.

     The defendants, namely Ching Chun Wai trading as Sang Kwong Decoration Engineering and Basic Tank (Knitwear) Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $25,611.24 and $11,542.38 respectively, being mandatory contributions in arrears and surcharges payable.

     The amount awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the defendants to pay $230 and $130 as the costs in respect of the claims.
