The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
A company director was fined $15,000 at the Kwun Tong Magistracy today (March 4), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).
Kong Man Lung, director of Decollin International Limited, was charged for offences under section 7A(8) and section 44 of the ordinance. The defendant pleaded guilty to six counts of failing to make MPF contributions for an employee within the prescribed time for the contribution period between November 2006 and April 2007. The defendant was fined $2,500 for each of the summonses, totalling $15,000.
The Mandatory Provident Fund Schemes Authority (MPFA) today also obtained two orders for payment of outstanding MPF contributions at about $95,000 against two employers in the District Court.
The District Court today issued two judgments against two employers, Paul A. Engineers O/B Big Project Development Limited and Wing On Dispensary Limited. The defendants were ordered to pay the MPFA the sums of $65,075 and 30,597.04, being mandatory contributions in arrears and surcharges payable to two and seven employees of the defendants respectively.
Meanwhile, the MPFA today pursued one claim in the Small Claims Tribunal for some $2,000 on behalf of one employee, who was owed MPF contributions by his employer.
At the tribunal¡¦s hearing today, the defendant Asgain Company Limited did not dispute the amount claimed. The adjudicator ordered it to pay the MPFA the sum of $2,374.9, being mandatory contributions in arrears and surcharges payable.
The amounts awarded at the District Court and the tribunal will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to pay $930 each as the costs and the tribunal ordered the defendant to pay $186 as the costs in respect of the claim.
