Two employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority (MPFA):

     Two employers were fined $6,000 at the Kwun Tong Magistracy today (February 2), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Man Lee Express Company Limited pleaded guilty to an offence under section 7(1A)(b) of the ordinance. The defendant was fined $3,000 for the summons for failing to enroll an employee in an MPF scheme as required by the ordinance.

     Cheng Sui Ping Angela trading as Johnny Boyz Seafood & Oyster Bar pleaded guilty to an offence under section 7(1) of the ordinance. The defendant was fined $3,000 for the summons for failing to enroll an employee in an MPF scheme as required by the ordinance.

     Meanwhile, the MPFA today pursued one claim in the Small Claims Tribunal for some $28,000 on behalf of five employees, who were owed MPF contributions by their employer.

     At the tribunal¡¦s hearing today, the defendant, Wing Ho Investments Limited, did not appear. In its absence, the adjudicator ordered it to pay the MPFA the sum of $28,428.35, being mandatory contributions in arrears and surcharges payable.

     The amount awarded at the tribunal will be reimbursed to the employees¡¦ MPF accounts as soon as it is received by the MPFA. The tribunal further ordered the defendant to pay $120 as the costs in respect of the claim.
