The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
Two employers were fined $10,800 at the Kwun Tong Magistracy today (December 2), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).
Roger Sze & Associates Ltd was charged under section 7(1A)(b) of the ordinance and pleaded guilty to a count for failing to enrol an employee in MPF schemes as required by the ordinance and was fined $3,000 for the summons.
Chan Choi Hing trading as Ka Yiu Knitting Factory was charged under section 7A(8) of the ordinance. The defendant pleaded guilty to six counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between February and July 2007. The defendant was fined $1,300 for each summons, totalling $7,800.
The Mandatory Provident Fund Schemes Authority (MPFA) today also obtained orders for payment of outstanding MPF contributions at about $220,000 against two employers in the District Court.
The District Court issued judgments against Cheng Ping Chuen and Cheng Chi Ho Danny trading as Tak Lok Fashion Factory and Leung Yuen Hon trading as Pak See Kut Cake Shop. The defendants were ordered to pay the MPFA $172,348.08 and 56,117.26, being mandatory contributions in arrears and surcharges payable to eight and five employees of the defendants respectively.
The MPFA today pursued three claims in the Small Claims Tribunal for about $34,000 on behalf of nine employees, who were owed MPF contributions by their employers.
Free To Billions International Company Limited, Fidelity Concept Development Limited trading as Royal Plaza Restaurant, and Multipipe Renovation Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $22,718.12, $8,751.79 and $2,949.06, being mandatory contributions in arrears and surcharges payable.
The amounts awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to pay costs of $970 and $930 as costs respectively and the tribunal ordered the respective defendants to pay costs of $206, $90 and $146.
