Proprietor fined for violation of safety rules

     Shun Luen Construction Limited was fined $17,000 at Kowloon City Magistrates' Court today (September 22) for violation of the Factories and Industrial Undertakings Ordinance. The prosecutions were launched by the Labour Department.

     The case involved a fatal accident on January 4 this year at a construction site in Kowloon Tong. A worker was struck by a pile of metal sheets fallen from a mobile crane and died.

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, a proprietor shall provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risks to the health of the person employed. Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.

     In addition, Regulation 7J(1)(b) of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations states that a proprietor shall ensure that the load being raised or lowered by the lifting appliance is adequately secured. Any proprietor who fails to do so is liable to a fine of $200,000.
