Proprietor fined for violation of safety rules

     Wealthy Recycling Company Limited was fined $21,000 at Kwun Tong Magistrates' Court today (September 11) for violation of the Factories and Industrial Undertakings Ordinance. The prosecution was launched by the Labour Department.

     The case involved a fatal accident on September 2 last year at a metal scrap recycling factory in Yau Tong. A worker was electrocuted while using electric arc welding equipment.

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, a proprietor must provide and maintain a plant that is, as far as is reasonably practicable, safe and without risks to health for the person employed. Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.
              
     In addition, Regulation 9 of the Factories and Industrial Undertakings (Electricity) Regulations stipulates that the proprietor shall ensure that every electrical connection is properly constructed and designed as regards protection.  Any proprietor who fails to do so is liable to a fine of $50,000.
