Two contractors fined for violation of safety rules

    Gammon Construction Limited was fined $30,000 and Yung Kee Ironware Engineering fined $25,000 at Eastern Magistrates' Court today (July 2) for violation of Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations.  The prosecutions were launched by the Labour Department.

    The case involved a fatal accident at a Quarry Bay construction site on February 4, 2007. A worker assisting in a lifting operation was fatally injured when he fell from a lift shaft entrance subsequent to the collapse of a winch system during its lifting operation inside the lift shaft.

    According to Regulation 7D(1) of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations, the contractor must take appropriate precautions to ensure the stability of a lifting appliance.  Any contractor who fails to do so is liable to a fine of $200,000.

    According to Regulation 5 of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations, the contractor must ensure that a lifting appliance is periodically tested and examined.  Any contractor who fails to do so is liable to a fine of $200,000.
