Two employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

    Two employers were fined a total of $18,000 at the Kwun Tong Magistracy today (June 3), after being convicted of offences under the Mandatory Provident Fund (MPF) Schemes Ordinance (Cap. 485).

    Yvonne Fung Yuk Ching trading as Hong Kong Transportation Company pleaded guilty to an offence under section 7(1) of the ordinance. The defendant was fined $10,000 for failing to enrol an employee in MPF scheme as required by the ordinance.

    Supply Chain Consulting (Hong Kong) Limited formerly known as Viewlocity HK Limited pleaded guilty to an offence under section 7(1) of the ordinance andwas fined $8,000 for failing to enrol an employee in MPF scheme.

    The Mandatory Provident Fund Schemes Authority (MPFA) today also pursued six claims in the Small Claims Tribunal for about $112,000 on behalf of 127 employees, who were owed MPF contributions by their employers.

    Defendant Lui Kwok Fai, formerly trading as Ng Kee Paper Box Company, did not dispute the amounts claimed. The Adjudicator ordered him to pay the MPFA $48,310.50, being mandatory contributions in arrears and surcharges payable.

    The other five defendants, 3333 Limited trading as Top Choice Seafood and Hotpot Restaurant, Goldwise International Limited trading as Mini Paris Vietnamese Restaurant, Best Smoothness Investment Limited trading as Lung Hin Court Hot Pot Seafood Restaurant (translation), Wah Fai Wang Lee Limited trading as Wang Lee Restaurant and General Central Engineering Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $44,058.36, $14,198.87, $3,642.60, $1,309.79 and $600, being mandatory contributions in arrears and surcharges payable.

    The amounts awarded at the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The Tribunal ordered the respective defendants to pay costs of $260, $246, $106, $150, $60 and $76.
