The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
The Mandatory Provident Fund Schemes Authority (MPFA) today (March 20) obtained orders in the District Court against three employers for payment of outstanding MPF contributions of about $209,000. The MPFA also pursued four claims in the Small Claims Tribunal for some $38,000 on behalf of 11 employees, who were owed MPF contributions.
The District Court today issued judgments against American Nutrition Company Limited, Prime Consultants Limited trading as Winfield Motors Co and Good View Food Manufactory Limited. The defendants were ordered to pay the MPFA $90,085, $77,146.97 and $42,095.49, being mandatory contributions in arrears and surcharges payable to six, seven and 27 employees of the defendants respectively.
At the tribunal's hearing, Well Union & Union Limited did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $8,678.92, being mandatory contributions in arrears and surcharges payable.
The other defendants, Ziehl-Ebm (HK) Ltd, So Kwan Shuk formerly trading as South East Asia Native Products and Ngai Fat Tai trading as Kam Yuen Restaurant, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $24,915.24, $2,670 and $1,785.15, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to each pay costs of $930. The tribunal ordered the respective defendants to pay costs of $96, $126, $210 and $130.
