Proprietor fined $35,000 for violation of safety rules

    Shiu Wing Steel Limited was fined $35,000 at Tuen Mun Magistrates' Courts today (January 4) for violation of the Factories and Industrial Undertakings Ordinance and the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations.  The prosecution was launched by the Labour Department.

     The case involved a fatal accident on April 10, 2007, at a workplace in Tuen Mun. A worker died after being struck by a bundle of steel bars which was being lifted by an overhead travelling crane.

     Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance says the proprietor must provide and maintain a system of work that is safe and without risk to the health of workers. Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.              

     According to Regulation 4(b) of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations, the owner of a lifting appliance must ensure that it is not used unless it is properly maintained. Failure to do so could mean a fine of $200,000.
