Proprietor fined $50,000 for safety violations

    City Pipe Technologies (Hong Kong) Limited was fined $50,000 at Shatin Magistrates' Court today (December 28) for violation of the Factories and Industrial Undertakings Ordinance. The prosecution was launched by the Labour Department.

     The case involved a fatal accident on February 3, 2006, at a manhole in Tai Po. A worker died and another two workers were injured as a result of inhalation of toxic gas in a confined space.

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide and maintain a system of work that is safe and without risk to the health of workers.  Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.

     According to Section 9(b) of the Factories and Industrial Undertakings (Confined Spaces) Regulation, the proprietor shall ensure that a person remaining in a confined space is properly wearing an appropriate approved breathing apparatus and a suitable safety harness connected to a lifeline. Any proprietor who fails to do so is liable to a fine of $100,000 and to imprisonment for six months.

     According to Section 11(2) of the Factories and Industrial Undertakings (Confined Spaces) Regulation, the proprietor shall provide all necessary equipment to ensure the safety and health of workers in a confined space.  Any proprietor who fails to do so is liable to a fine of $100,000 and to imprisonment for six months.
