Employer fined for violating safety rule

    Why Not Transportation Limited was fined $20,000 at Kwun Tong Magistrates' Court today (December 4) for violation of the Occupational Safety and Health Ordinance.  The prosecution was launched by the Labour Department.

     The case involved a fatal accident which occurred on September 3, 2006, at a workplace in Kowloon Bay.  A worker was struck to death by a forklift truck against the tailgate of a lorry when he was assisting in loading goods onto a lorry.

     According to Section 6(1), 6(2)(a) and 6(2)(c) of the Occupational Safety and Health Ordinance, the employer shall provide a safe system of work, and the necessary information, instruction and supervision to ensure the safety and health of the employee.  Any employer who fails to do so is liable to a fine of $200,000 and to imprisonment for six months.
