Three employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (October 5) obtained two orders in the High Court for payment of outstanding MPF contributions at about $340,000 against two employers. The MPFA pursued one claim in the Small Claims Tribunal for some $13,000 on behalf of three employees, who were owed MPF contributions by their employers.

     The High Court today issued judgments against Goldjade Holdings Limited trading as Roda Japanese Restaurant and Bright Smooth (HK) Limited trading as Roda Japanese Whampoa Restaurant. The defendants were ordered to pay the MPFA the sums of $164,578.10 and $178,959.38 respectively, being mandatory contributions in arrears and surcharges payable to 27 and 28 employees of the respective defendants.

     At the tribunal's hearing today, the defendant, Ie Sioe Ging trading as Wah Kee Motor Co. did not appear.  In its absence, the Adjudicator ordered it to pay the MPFA the sum of $7,298.62, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the High Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The High Court further ordered the respective defendants to pay costs of $930 each for the High Court cases and the tribunal ordered the defendant to pay $180 costs for the tribunal case.
