Five employers ordered to pay MPF non-payment

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (Septembe 25) obtained four orders in the District Court for payment of outstanding MPF contributions at about $1,100,000 against four employers. The MPFA pursued one claim in the Small Claims Tribunal for some $6,000 on behalf of one employee, who was owed MPF contributions by the employer.

     The District Court today issued judgments against Choi Ming Restaurant (Holdings) Limited, Peco Security System Limited, Wong Sik Wah trading as Lai Wah Transportation, Ng Shu Fan trading as Chu Choi Kee and Suen Wai Ling formerly trading as Chu Choi Kee. The defendants were ordered to pay the MPFA the respective sums of $298,600.73, $257,208.65, $249,144.62 and $134,388.55 (another $178,267.95 to be paid by Ng Shu Fan trading as Chu Choi Kee only), being mandatory contributions in arrears and surcharges payable to 59, 5, 7 and 20 employees of the respective defendants.

     At the tribunal's hearing, the defendant, Myung Dong Express Co. Limited trading as Myung Dong Express, did not appear. In its absence, the Adjudicator ordered it to pay the MPFA $6,240, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court further ordered the respective defendants to pay costs of $930 each for the District Court cases and the Tribunal ordered the defendant to pay $114 as costs in respect of the claim.
