The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
The Mandatory Provident Fund Schemes Authority (MPFA) has obtained an order in the District Court for payment of outstanding MPF contributions at about $380,000 against an employer.
The MPFA today (August 31) pursued five claims in the Small Claims Tribunal for some $100,000 on behalf of 26 employees, who were owed MPF contributions by their employers.
The District Court issued a judgment against Chief Way Engineering Limited which was ordered to pay the MPFA $387,619.18, being mandatory contributions in arrears and surcharges payable to 16 employees.
At the tribunal's hearing, two defendants - Chan Ping Hong trading as Express Engineering Co. and Clever Mind Limited - did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $49,209.76 and 5,301.54, being mandatory contributions in arrears and surcharges payable.
Three defendants - Shum Yuk Wah trading as Shanghai Mei Mei Soya Bean King's, City One Services Management Limited and Ocean Mark Limited - did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $23,572.34, $20,376.41 and $8,600, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court further ordered the defendant to pay cost of $930 and the tribunal ordered each of the respective defendants to pay $170, $136, $180, $206 and $96 for the tribunal cases.
