Employer ordered to pay MPF non-payment

The following is issued on behalf of The Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (August 2) pursued a claim in the Small Claims Tribunal for some $12,000 on behalf of three employees, who were owed MPF contributions by their employers.

     At the tribunal's hearing, the defendant, Shea Shum Sum, did not appear. In his absence, the Adjudicator ordered him to pay the MPFA $12,541.82, being mandatory contributions in arrears and surcharges payable.

     The Adjudicator also ordered the defendant to pay the MPFA $5,000 being financial penalty imposed by the MPFA for failure to make MPF contributions for employees.

     The amount awarded will be reimbursed to the employees' MPF accounts as soon as it is received by the MPFA. The tribunal further ordered defendant to pay $220 as cost in respect of the claim.
