Nine employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (November 15) pursued nine claims in the Small Claims Tribunal for some $210,000 on behalf of 91 employees, who were owed MPF contributions by their employers.

     At today's hearing, the five defendants, including Fung Man Kai, Well Union Maritime Limited, Fung Kwok Yau trading as Kin Yau Construction Co., Hoi On Security Company Limited and Wai Keung Construction (Hong Kong) Company Limited, did not dispute the amount claimed.  The Adjudicator ordered them to pay the MPFA the sums of  $39,647.84, $38,200, $29,925, $23,300.13 and $11,153.65, being mandatory contributions in arrears and surcharges payable.

     The other four defendants, including Adco Design & Printing Limited, Century Eastern Limited formerly trading as Ying Fook Seafood Restaurant, Ip Kin Tsiu & Yim Chun Yuen formerly trading as Chung Yin Travel Services Company and CTL (Container Transport & Logistics) Limited, did not appear at today¡¦s hearing.  In their absence, the Adjudicator ordered them to pay the MPFA the sums of $31,304.96, $23,468.66, $11,970 and $389.34, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA.  The court further awarded payments of $220, $260, $180, $210, $90, $220, $186, $170 and $160 as the costs in respect of the claims.

     Wai Keung Construction (Hong Kong) Company Limited pleaded guilty at Kwun Tong Magistracy earlier to two counts of failing to make MPF contributions on time and was fined $8,000.
