Six employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (October 6) obtained an order for payment of outstanding MPF contributions at around $93,000 against an employer in the District Court. Meanwhile, the MPFA pursued five claims in the Small Claims Tribunal for some $160,000 on behalf of 11 employees, who were owed MPF contributions by their employers.

     The District Court today issued a judgment against an employer, namely, Chan Ho Yin trading as Koon Lam Seafood Rest(New Fu Hing). The defendant was ordered to pay the MPFA the sum of $93,483.88, being mandatory contributions in arrears and surcharges payable to two employees of the defendant.

     At the Tribunal's hearing today, the defendants, Chynchen Associates Limited and Reeds Bakery Chain Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $37,686.53 and $35,104.45, being mandatory contributions in arrears and surcharges payable.

     The other three defendants, including Chiu Kong Chi trading as Mee King Brassieres Factory, Lee Yiu Keung Kelvin trading as Chelsea Apparel Manufacturing Co. and Topmond Food Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $48,790.18, $29,752.26 and $7,693 being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for the District Court case and $260, $260, $230, $180 and $100 as the costs in respect of the Small Claims Tribunal cases.
