
Registered General Building Contractor disciplined for offences relating to building works

The Registered Contractors' Disciplinary Board has completed disciplinary inquiries under the Buildings Ordinance (BO) on two fatal incidents at construction sites and decided that the Registered General Building Contractor (RGBC) concerned should be disciplined for having been convicted by courts of offences relating to building works.
The Board ordered the RGBC to be fined $320,000 in total. Also, the RGBC was ordered to pay $128,600 in total, being the costs of the Board and the Buildings Department (BD) for conducting the inquiries.

The first case involved a fatal incident that occurred at a construction site in Kai Tak on June 27, 2020. At the topmost floor of a building under construction, a metal beam being installed fell down and struck a bamboo scaffold being erected below at the external wall of the building, causing a scaffolder to plunge to his death. The RGBC was prosecuted by the Labour Department (LD) for violation of the Factories and Industrial Undertakings Ordinance. The RGBC was convicted and fined $25,000 at the Kowloon City Magistrates' Courts on February 4, 2022. In view of the convictions of the RGBC, the BD notified the Board for its consideration of disciplinary action against the RGBC under the provisions of section 13(1) of the BO. Upon completion of the disciplinary inquiry, the Board ordered the RGBC to be fined $150,000 and to pay a total of $64,800 being the costs of the Board and the BD for conducting the inquiry.
The second case involved a fatal incident that occurred at a construction site in Tseung Kwan O on October 24, 2021. A worker fell through a floor opening to the floor below while taking records on the completion of debris-cleaning work. The worker sustained injuries and passed away on the same day. The RGBC was prosecuted by the LD for violation of the Construction Sites (Safety) Regulations and the Factories and Industrial Undertakings (Safety Management) Regulation. The RGBC was convicted and fined $80,000 at the Kwun Tong Magistrates' Courts on April 24, 2023. In view of the convictions of the RGBC, the BD notified the Board for its consideration of disciplinary action against the RGBC under the provision of section 13(1) of the BO. Upon completion of the disciplinary inquiry, the Board ordered the RGBC to be fined $170,000 and to pay a total of $63,800 being the costs of the Board and the BD for conducting the inquiry.
A spokesperson for the BD reiterated that any registered contractor who contravenes the relevant provisions of the BO in carrying out building works, or is convicted by any court of an offence relating to building works, or has been negligent or has misconducted himself in building works, will be subject to enforcement action including criminal prosecution and disciplinary action under the BO.
