Two men jailed for conducting illicit fuelling activities

     Two men were convicted and each sentenced to 14 days' imprisonment at the West Kowloon Magistrates' Courts yesterday (October 30) for conducting illicit fuelling activities, in contravention of the Fire Services Ordinance and the Dangerous Goods Ordinance. 

     The Fire Services Department (FSD) mounted operations against illicit fuelling activities in Kwai Tsing District on April 17 and 30, seizing a total of 5 565 litres of fuel and stopping two men. The men were prosecuted for breaching the Fire Services Ordinance and the Dangerous Goods Ordinance, with two and three charges laid against them respectively. They were convicted at the West Kowloon Magistrates' Courts and sentenced to 14 days' imprisonment for each charge, with the sentences to run concurrently.

     Under the Fire Services (Fire Hazard Abatement) Regulation, it is an offence to possess or control any controlled substance for the business purpose of transferring it into vehicle fuel tanks. The Dangerous Goods Ordinance also provides that no person shall manufacture, store, convey or use any dangerous goods unless they possess a licence or exemption granted. Upon conviction, the maximum penalty for each offence is a fine of $200,000 and imprisonment for one year.

     In addition, according to the Dangerous Goods (Control) Regulation, it is an offence for any person to store or convey, or cause or permit to be stored or conveyed dangerous goods specified in the regulations, unless the requirements of the relevant dangerous goods' packaging, marking and labelling are complied with. Upon conviction, the maximum penalty is a fine of $100,000 and imprisonment for six months.

     The FSD is committed to combating illicit fuelling activities through a multipronged strategy to ensure the safety of the community. Members of the public are reminded to refrain from participating in such activities and patronising illegal fuelling stations. Should any suspected illicit fuelling activities be observed, please report them through the Illicit Fuelling Activities on the Fire Hazard Electronic Complaint Portal of the FSD (fhcp.hkfsd.gov.hk) or by calling the 24-hour reporting hotline at 5577 9666.
