Shop on Kweilin Street in Sham Shui Po convicted of causing noise nuisance while peddling goods

     ​Ka Wo Farming Limited, which sells vegetables and fruits and is located on Kweilin Street in Sham Shui Po, and its director were convicted and fined a total of $10,000 at Kwun Tong Magistrates' Courts today (December 22) for contravening the Noise Control Ordinance (NCO) by causing noise nuisance to nearby residents through persistently using loudspeakers by the shop while peddling goods.

     A spokesman for the Environmental Protection Department (EPD) said that the department has been strictly combating noise nuisance caused by shop peddling in various districts. In 2022, the EPD has collaborated with the Police to take multiple rounds of joint enforcement action against noise nuisance caused by shop peddling in Sham Shui Po (including the vicinity of Pei Ho Street Market and Apliu Street). A total of 26 cases in the district have been convicted by the courts for contravening the NCO, with fines of $114,100 in total. Apart from prosecuting non-compliant companies, the EPD also prosecutes their directors with repeated offences in accordance with the law, with a view to stiffening penalties and strengthening the deterrent effect.

     The spokesman reminded persons responsible for retail shops and hawkers that they should not use street cries or play promotional recordings in public places to attract customers, so as to avoid causing noise nuisance to nearby residents. Any person who commits an offence under the relevant sections of the NCO shall be liable to a maximum fine of $10,000. Operators or directors of shops with repeated contraventions will also be liable personally for their offences once convicted. The EPD is considering to amend the NCO to strengthen the control over noise from loudspeakers for peddling goods, including the proposed introduction of a Fixed Penalty System and prohibition on the use of loudspeakers for peddling goods, so as to effectively control and remediate associated noise nuisance.
