Company and its director fined $58,800 for contravening Employment Ordinance

     ​Berlinetta (Asia) Holdings Limited and its director were prosecuted by the Labour Department (LD) for violation of the requirements under the Employment Ordinance (EO). The company and its director pleaded guilty at Eastern Magistrates' Courts today (October 7) and were fined a total of $58,800. Both defendants were also ordered to pay jointly and severally an outstanding sum of about $29,000 via the court to two employees concerned.
 
     The company failed to pay three employees, in accordance with the EO, wages within seven days after the expiry of the wage periods, and end-of-year payments within seven days after the day specified in the employment contract for paying end-of-year payments, totalling about $154,000. The director was prosecuted and convicted for his consent, connivance or neglect in the above wage offences.

    "The ruling will disseminate a strong message to all employers, directors and responsible officers of companies that they have to pay wages and end-of-year payments to employees in accordance with the EO," a spokesman for the LD said.

    "The LD will not tolerate these offences and will spare no effort in enforcing the law and safeguarding employees' statutory rights," the spokesman added.
