Person responsible for nightclub sentenced to imprisonment for contravening Prevention and Control of Disease Ordinance

     A person responsible for a nightclub was sentenced to ten days' imprisonment for contravening sections 9(1) and 9(2) of the Prevention and Control of Disease (Requirements and Directions) (Business and Premises) Regulation (Cap. 599F) by the Kowloon City Magistrates' Courts yesterday (February 15) for failing to comply with the regulation of ensuring that all staff members involved in the operation of business on the premises have received the first dose of COVID-19 vaccine and keep the vaccination record as proof of vaccination. 

     A spokesman for the Food and Environmental Hygiene Department (FEHD) said that during the FEHD's joint operation with the Police in Mong Kok District on June 19, 2021, FEHD officers found that the premises failed to comply with the above-mentioned Regulation and direction. Prosecution was therefore instituted against the person concerned.

     The spokesman reminded operators of catering premises and other relevant premises that it is a criminal offence to contravene the above Regulation. Offenders are liable, upon conviction, to a maximum fine of $50,000 and imprisonment for six months. 

     The spokesman said that the FEHD will continue to take enforcement action to ensure that operators of catering premises and other relevant premises comply with the Regulation and directions, and also appealed for their continuous support for the anti-epidemic work.
