Company and its director fined $53,600 for contravening Employment Ordinance

     Chun Ho Construction (H.K.) Limited and its director were prosecuted by the Labour Department (LD) for failing to make timely payment of wages and the sum awarded by the Labour Tribunal (LT) to an employee, contrary to the Employment Ordinance (EO). The company and its director pleaded guilty at Kowloon City Magistrates' Courts today (August 30) and were each fined $26,800, making a total fine of $53,600.

     The company failed to pay wages to an employee within seven days after the expiry of the wage periods or the termination of employment, and the sum of about $82,000 awarded by the LT within 14 days after the date set by the LT, in accordance with the requirements of the EO. The director concerned was convicted for his consent, connivance or neglect in the above offences.

     "The ruling helps disseminate a strong message to all employers, directors and responsible officers of companies that they have to pay wages to employees within the statutory time limit stipulated in the EO, as well as the sums awarded by the LT or the Minor Employment Claims Adjudication Board," a spokesman for the LD said.

     "The LD will not tolerate these offences and will spare no effort in enforcing the law and safeguarding employees' statutory rights," the spokesman added.
