Works contractors of Causeway Bay Sogo Department Store convicted for illegally carrying out works at night
     The main contractor, a sub-contractor and a worker engaged by Sogo Department Store in Causeway Bay carried out scaffolding works and conducted renovation works at night and caused noise nuisance. They were fined a total of $30,500 by Eastern Magistrates' Courts on October 16 last year and today (January 15) for contravening the Noise Control Ordinance (NCO).

     The Environmental Protection Department (EPD) received a complaint in March last year about the noise nuisance caused by the night construction work of Sogo Department Store at Hennessy Road in Causeway Bay. Upon investigation, EPD staff found that the contractors carried out scaffolding works at the building's external wall and cleared up debris at the basement late at night without a valid Construction Noise Permit (CNP). After completion of evidence collection, the EPD initiated prosecutions against Rising Aerial Platform Company Limited, the contractor of the scaffolding works and the worker, as well as Deco Classic Limited, the main contractor of the renovation works, in accordance with the NCO.

     An EPD spokesman stressed that construction and renovation works should be scheduled for daytime and on non-general holidays to reduce the impact of noise to nearby residents. If the works must be conducted during the restricted hours (between 7pm and 7am on the following day, or any time on a general holiday), the contractor has to obtain prior approval from the EPD and be issued with a valid CNP after assessments by the EPD before the works can be carried out. Works issued with a valid CNP must be carried out according to the requirements set out in the CNP and implement the required noise mitigation measures to minimise noise impacts. Otherwise, it will constitute an offence. First-time offenders are liable to a maximum fine of $100,000. A maximum fine of $200,000 may be imposed on second or subsequent convictions.
