Private Columbaria Appeal Board announces Rules on Practice and Procedure

The Private Columbaria Appeal Board (the Appeal Board) today (December 29) announced the rules made on the lodging of appeals and the practice and procedure of the Appeal Board (the rules) under the Private Columbaria Ordinance (the Ordinance) (Cap. 630).
The Chairperson of the Appeal Board has made the rules to provide for the lodging of appeals and generally for regulating the practice and procedure of the Appeal Board in accordance with section 91 of the Ordinance.
The Rules on Practice and Procedure of the Appeal Board have been uploaded onto the Appeal Board’s website (www.pcab.hk) for public viewing.
The Appeal Board is established under the Ordinance to hear and determine an appeal lodged by an applicant or a holder of a specified instrument who is aggrieved by a decision made by the Private Columbaria Licensing Board or the Director of Food and Environmental Hygiene referred to in section 84(1) of the Ordinance.
A person who wishes to appeal against any decision referred to in section 84(1) must lodge a notice of appeal, in writing and in the specified form, with the Appeal Board within 21 days after the date on which the notice of the decision under appeal is given to the person. Please see also section 107 of the Ordinance, in particular subsections (3) and (4) thereof.
An Appeal Board consisting of a presiding officer and four panel members will be constituted for the purposes of an appeal. All presiding officers are legally qualified as defined in section 82 of the Ordinance, and are generally the Chairperson or a Deputy Chairperson of the Appeal Board.
