Company's ex-director/responsible officer fined for wage offences

     The ex-director/responsible officer of J.V. Fitness Limited was prosecuted by the Labour Department (LD) for committing wage offences under the Employment Ordinance (EO). The defendant pleaded guilty at Eastern Magistrates' Courts today (July 25) to the 101 summonses laid against him in respect of wage offences and was fined $202,000. The defendant was also ordered to pay the outstanding wages and the amount was about $370,000.

     J.V. Fitness Limited failed to pay wages to 99 employees within seven days after the expiry of the wage period as required by the EO and the amount involved was about $1.1 million. The responsible officer concerned was convicted for his consent, connivance or neglect in the above offences.

     "The ruling helps disseminate a strong message to all employers and responsible officers of companies that they have to pay wages to employees within the time limit in accordance with the EO. Failure to effect payment of wages as required by the EO is a serious offence and they should comply with the law. We will continue to make dedicated efforts in enforcing the EO and safeguarding employees' statutory rights," a spokesman for LD said.

     "If the wage offences are committed with the consent, connivance or neglect of the responsible officers of a company, such officers will be liable for the offences alike. The LD will bring employers and responsible officers of companies in contravention of the law to justice," the spokesman added.
