LegCo to debate motion under Article 73(9) of Basic Law

The following is issued on behalf of the Legislative Council Secretariat:

     The Legislative Council (LegCo) will hold a meeting on Wednesday (June 7) at 11am in the Chamber of the LegCo Complex. During the meeting, Members will debate a motion under Article 73(9) of the Basic Law.

     The motion, jointly initiated by Mr Alvin Yeung, Mr James To, Mr Leung Yiu-chung, Professor Joseph Lee, Mr Leung Kwok-hung, Ms Claudia Mo, Mr Wu Chi-wai, Mr Charles Mok, Mr Chan Chi-chuen, Mr Kenneth Leung, Dr Kwok Ka-ki, Mr Dennis Kwok, Dr Fernando Cheung, Dr Helena Wong, Mr Ip Kin-yuen, Mr Andrew Wan, Mr Chu Hoi-dick, Mr Lam Cheuk-ting, Mr Shiu Ka-chun, Dr Pierre Chan, Ms Tanya Chan, Mr Hui Chi-fung, Dr Cheng Chung-tai, Mr Kwong Chun-yu, Mr Jeremy Tam, Mr Nathan Law, Dr Yiu Chung-yim and Dr Lau Siu-lai (28 Members) and to be moved by Mr Alvin Yeung, states: "Whereas not less than one-fourth of all the Members of this Council have jointly initiated this motion charging the Chief Executive Mr Leung Chun-ying with serious breach of law and/or dereliction of duty (as particularised in the Schedule and Annex appended to this motion), and whereas the said Mr Leung Chun-ying has refused to resign within a reasonable time, this Council, in accordance with Article 73(9) of the Basic Law, hereby gives a mandate to the Chief Justice of the Court of Final Appeal to form and chair an independent investigation committee to investigate the alleged serious breaches of law and/or dereliction of duty and report its findings to this Council."

     Ms Claudia Mo will move a motion under Rule 49B(1A) of the Rules of Procedure. The motion states: "That this Council, in accordance with Article 79(7) of the Basic Law, censures Hon Holden Chow Ho-ding for misbehaviour and breach of oath under Article 104 of the Basic Law (details as particularised in the Schedule to this motion)."

     Dr Hon Helena Wong will move a motion on not forgetting the June 4 incident. The motion states: "That this Council urges that: the June 4 incident be not forgotten and the 1989 pro-democracy movement be vindicated."

     Mr Lam Cheuk-ting will move a motion on combating bid-rigging to defend the rights and interests of property owners. The motion states: "That in recent years building maintenance works in Hong Kong have been monopolised by bid-rigging syndicates involving triad members, and such syndicates manipulate tendering process by unlawful means, including significantly inflating maintenance costs to make huge profits, thus causing property owners to suffer losses of tens of billions of dollars, and arousing widespread grievances among members of the public; in order to combat the illegal activities of bid-rigging, this Council urges the Government to:
 
(1) expeditiously plug the relevant loopholes under the Building Management Ordinance to safeguard the rights and interests of property owners;
(2) step up law enforcement to deter bid-rigging syndicates;
(3) enhance public promotion and education to enable members of the public to understand the perils of bid-rigging and take precautions;
(4) provide property owners with professional support to enable them to comprehensively grasp the correct information on building maintenance works; and
(5) set up a 'building maintenance works authority' to centrally monitor the conduct of the industry and quality of maintenance."

     Mr Lau Kwok-fan, Mr Alvin Yeung, Dr Fernando Cheung and Mr Kwok Wai-keung will move separate amendments to Mr Lam Cheuk-ting's motion.

     In addition, Mr Chan Chun-ying will move a proposed resolution under section 34(4) of the Interpretation and General Clauses Ordinance to extend the period for amending the Financial Institutions (Resolution) (Protected Arrangements) Regulation and the Financial Institutions (Resolution) Ordinance (Commencement) Notice 2017 laid on the table of the Council on May 17, 2017 to the meeting of July 5, 2017.  

     On bills, the Stamp Duty (Amendment) (No. 2) Bill 2017 and the Medical Registration (Amendment) Bill 2017 will be introduced into the Council for the First Reading and the Second Reading. The Second Reading debate on the Bills will be adjourned.

     Members will also resume the Second Reading debate on the Inland Revenue (Amendment) (No. 3) Bill 2017. If the Bill is supported by Members and receives its Second Reading, it will then go through the Committee stage and be read the third time.

     During the meeting, Members will also ask the Government 22 questions on various policy areas, six of which require oral replies.
