Transcript of remarks by Chairman of Legislative Council Commission on deliberations made by the Commission

     Following is the remarks by the Chairman of The Legislative Council Commission (the Commission), Mr Andrew Leung, on the deliberations by the Commission at a media briefing at the Legislative Council (LegCo) Complex today (January 16):

     The first item is on the recovery of Members' remuneration and advanced operating funds from Mr Leung Chung-hang and Miss Yau Wai-ching. The Secretariat has not yet recovered the moneys.  After discussion, the Commission has maintained its position that the remuneration and advances should be recovered in full.  The Commission will commence the recovery action in court after the conclusion of the CFA (Court of Final Appeal) legal proceedings.

     The second item is to consider the requests from Hon Leung Kwok-hung, Dr Hon Lau Siu-lai and Dr Hon Yiu Chung-yim to pay for their legal costs.

     According to the Commission's prevailing policy, where individual Members are involved in judicial proceedings arising from the discharge of their LegCo duties in proceedings of LegCo or its committees, the Commission may consider bearing their legal expenses.

     As the three Members are not discharging their LegCo duties in the present case, after discussion and voting, the Commission decided not to accede to the Members' requests.
