Employer sentenced to imprisonment and fined for wage offences, non-payment of annual leave pay and default of award of the Labour Tribunal

     An employer, the proprietor of a trading company, was earlier convicted at Kwun Tong Magistrates' Courts for wage offences, non-payment of annual leave pay and defaulting on sums awarded by the Labour Tribunal (LT) under the Employment Ordinance (EO).  He was sentenced to three months' immediate imprisonment and fined $5,000 yesterday (November 3).

     The employer failed to pay wages and annual leave pay of about $415,000 to an employee within seven days after termination of employment as required by the EO. Also, he failed to pay the employee the awarded sum of about $739,000 within the period of the award specified by the LT.
 
     "The judgment is disseminating a strong message to all employers that they have to pay wages and annual leave pay to employees in accordance with EO and the awarded sum according to the terms of the award issued by the LT," a spokesman for the Labour Department said.

     "The Labour Department will not tolerate these offences and will spare no effort in enforcing the law and safeguarding employees' statutory rights," the spokesman added.
