EPD surveillance footage used in successful prosecution of lorry driver for illegal dumping of commercial and industrial waste

     A driver involved in illegal dumping of commercial and industrial waste was fined $6,000 at Fanling Magistrates' Courts today (November 1) for contravening the Waste Disposal Ordinance (WDO).

     A spokesman for the Environmental Protection Department (EPD) said that a surveillance camera installed at Wing Shun Street in Kwai Chung captured illegal disposal of used tyres by a lorry in April this year. The EPD traced the related lorry driver based on the video recordings and information provided by the vehicle owner. Although the driver refused to provide further information during the interview, the EPD managed to initiate prosecution with the collected evidence, and the driver was convicted by the court today.

     The spokesman reminded members of the transportation and logistics sectors not to dispose of waste illegally. Failure to do so may lead to prosecution by the EPD. Anyone who disposes of waste at public places or government land or without the permission of land owners will violate the WDO. First-time offenders are liable to a maximum fine of $200,000 and six months' imprisonment. A maximum fine of $500,000 and six months' imprisonment may be imposed on second or subsequent convictions. In addition, a daily fine of $10,000 may be imposed for a continuing offence.

     To better combat illegal waste disposal activities, the EPD installed surveillance cameras to facilitate the investigation work of enforcement officers. Since May last year, about 400 successful prosecutions against flytipping cases have been made, with a fine of $30,000 and imprisonment for three weeks as the heaviest penalty.
