Subsidiary legislation under Competition Ordinance gazetted

     The Competition (Application of Provisions) Regulation, the Competition (Disapplication of Provisions) Regulation, the Competition (Turnover) Regulation and the Competition Ordinance (Commencement) Notice 2015 were published in the Gazette today (February 18).

     The Competition Ordinance was passed in June 2012 by the Legislative Council to provide a legal framework to curb anti-competitive conduct in various sectors.  

     "The Ordinance was designed to be implemented in phases. The Administration, the Judiciary and the Competition Commission have been working on the preparatory work necessary for the full commencement of the Ordinance. On the part of the Administration, the making of the subsidiary legislation published in the Gazette today is necessary to prepare for the full implementation of the Ordinance," a spokesman for the Commerce and Economic Development Bureau said.

     The Competition (Application of Provisions) Regulation applies the key provisions of the Ordinance to six statutory bodies, while the Competition (Disapplication of Provisions) Regulation disapplies the key provisions to seven non-statutory bodies. The Competition (Turnover) Regulation provides for the determination of turnover of an undertaking and specifies the turnover period for the purpose of the Ordinance. The Competition Ordinance (Commencement) Notice 2015 brings the empowering and related provisions relating to the Competition (Application of Provisions) Regulation and the Competition (Disapplication of Provisions) Regulation into operation.

     The above subsidiary legislation will be tabled at the Legislative Council for negative vetting on February 25.
