Disciplinary actions taken against registered lift contractor and engineer

     The registered lift contractor and engineer disciplinary boards (the boards) have completed disciplinary hearings on the performance of Otis Elevator Company (H.K.) Limited (Otis) and Engineer, Mr Ng Siu-man. The boards decided that both shall be disciplined for contravening relevant provisions of the Lifts and Escalators (Safety) Ordinance.  

     The boards imposed a fine of $240,000 on Otis, and ordered Mr Ng Siu-man to be reprimanded. Otis and Mr Ng were also ordered to pay $98,300 and $56,100 respectively for the costs incurred in the proceedings. The boards' decisions were published in the Gazette today (January 3).      Otis committed five disciplinary offences. The first offence arose following its conviction by Shatin Magistrates' Courts on January 17, 2011 for contravention of the Ordinance while being the registered lift contractor engaged to carry out lifts works at Heng Shan House, Heng On Estate, Ma On Shan. Three other offences arose following its conviction by Kwun Tong Magistrates' Courts on March 11, 2011 for contravention of the Ordinance while being the registered lift contractor engaged to carry out lift works at Hiu Ming Court, 26-38 Hiu Kwong Street, Kwun Tong. The last offence involved failure to ensure the screening of the counterweight of the lift at Viet Luen Factory Building, 126 Wai Yip Street, Kwun Tong, contravening the Code of Practice on the Design and Construction of Lifts and Escalators.

     Mr Ng committed a disciplinary offence that arose following his conviction by Shatin Magistrates' Courts on January 17, 2011 for contravention of the Ordinance while being the registered lift engineer engaged to carry out a lift examination at Heng Shan House, Heng On Estate, Ma On Shan.

     In exercising the power under sections 9(1) and 11G(1) of the Lifts and Escalators (Safety) Ordinance (Cap 327), the Director of Electrical and Mechanical Services referred the alleged disciplinary offences of Otis and Mr Ng to the boards which were appointed by the Secretary for Development for hearings. The boards are composed of registered professional engineers, authorised persons and registered persons nominated by professional institutions and trade organisations.
