Employer fined for violation of Employees' Compensation Ordinance and Employment Ordinance

     Pang Lee Transportation Company Limited was fined a total of $90,000 at Fanling Magistrates' Courts today (September 4) for failing to give notice of a non-fatal accident of its employee, not taking out insurance cover for its employee, and non-payment of periodical payments and holiday pay, in accordance with the Employees' Compensation Ordinance and the Employment Ordinance. The Court also ordered the defendant company to clear the outstanding holiday pay. The prosecution was launched by the Labour Department.

     A cross-border container truck driver working for the defending company sustained a spinal fracture in a traffic accident while he was on duty. However, the company failed to report the accident to the Labour Department, failed to take out an insurance policy for its employee, and failed to pay periodical payment to make up the loss of earnings due to injury as required by the Employees' Compensation Ordinance. In addition, the company failed to pay holiday pay to the said employee as required by the Employment Ordinance.
