     Following is the transcript of the remarks by the Secretary for Justice, Mr Wong Yan Lung, SC, at a media session on the Legislative Council's motion to repeal the Country Parks (Designation) (Consolidation) (Amendment) Order 2010 today (October 11) (English portion):

Reporter: How do you comment on the legislators' views that the Ordinance is a subsidiary legislation and can be repealed?

Secretary for Justice: I don't think there's any issue between Legco and the Administration that the relevant order is subsidiary legislation. I think the difference in opinion is that pursuant to the section I mentioned earlier, section 34 (2) of Cap 1, the extent of the power and the limitation on the power, we do have a difference in opinion in relation to the interpretation. It doesn't turn on whether it is subsidiary legislation or not but it turns on the scope of the power and relevant limitation.

Reporter: Will you seek a judicial review by the court to deal with the issue?

Secretary for Justice: I think I have already answered this in Chinese. The most important task ahead of us now is to study the decision of the President very carefully to consider whether there are any perspectives we need to study further. This is a matter calling for great prudence on our part and we would certainly subject all these points to very careful consideration.
