Intercountry Adoption (Contracting States) Order 2010 gazetted

     The Intercountry Adoption (Contracting States) Order 2010 (the Order) made by the Secretary for Labour and Welfare under section 20D of the Adoption Ordinance (Cap. 290) was published in the Gazette today (July 9).

     The Order declares that the Republic of Cape Verde (Cape Verde) and the Togolese Republic (Togo), which have recently acceded to the Hague Convention on Protection of Children and Co-operation in respect of Intercountry Adoption (the Convention), are Contracting States to the Convention.  It also adds the two states to the list of Contracting States to the Convention scheduled to the Intercountry Adoption (Contracting States) Order (Cap. 290 sub. leg. C).  

     In accordance with the Convention, the Order has specified that the Convention has entered into force between the Hong Kong Special Administrative Region (HKSAR) and Cape Verde on January 1, 2010, and Togo on February 1, 2010.  

     The Convention sets out, inter alia, a framework for international co-operation in intercountry adoptions, and its implementation in Hong Kong is governed by the Adoption Ordinance.  The Convention is currently in force in 81 states.  Upon commencement of the Order, adoptions between HKSAR and Cape Verde and Togo will be arranged in accordance with the Convention.
