Child Abduction and Custody (Parties to Convention) (Amendment) Order 2010 gazetted

     The Child Abduction and Custody (Parties to Convention) (Amendment) Order 2010 (the Amendment Order) made by the Chief Executive under Section 4 of the Child Abduction and Custody Ordinance is published in the Gazette today (June 18).

     The Amendment Order adds four countries, namely the Republic of Albania, the Republic of Armenia, the Republic of San Marino and the Republic of Seychelles (the four newly acceding states), to the list of contracting states in the Child Abduction and Custody (Parties to Convention) Order (Chapter 512A) (the Order), so as to implement the Hague Convention on the Civil Aspects of International Child Abduction (the Convention) between the Hong Kong Special Administrative Region (HKSAR) and the four newly acceding states.  The Central People's Government accepted the accessions of the four newly acceding states to the Convention on behalf of the HKSAR in January 2010.

     The Amendment Order also replaces the Federal Republic of Yugoslavia (FRY) in the list of contracting states in the Order with its two succeeding states, namely Montenegro and the Republic of Serbia, to reflect the dissolution of FRY.

     A spokesman for the Labour and Welfare Bureau said that the Convention provided an effective international mechanism for the swift return of children wrongfully removed from their place of habitual residence to another contracting state in violation of custodial rights.  The Convention is now in force in 82 states.

     In accordance with the requirements of the Convention, the Amendment Order has taken effect since April 1, 2010.
