18 employers ordered to pay MPF arrears

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (April 19) pursued 16 claims in the Small Claims Tribunal for some $240,000 on behalf of 85 employees, who were owed MPF contributions by their employers.

     At the Tribunal's hearing today, three defendants, New Wave Workshop Limited, Energie Building Supplies Limited and Man Kwok Chuen trading as Carrier Motors Company, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $13,271.86, $12,577.15 and $11,576.58, being mandatory contributions in arrears and surcharges payable.

     The other 13 defendants, namely Quick Colour Printing Limited, Ng Shu Fan trading as Chu Choi Kee, Wah Tai Farm Company Limited, Vinfair Cargo Survey Co., Limited, G & H Holdings Limited, Pretty Garments (HK) Limited, UFO Trading Company Limited, 100 Flavor Restaurant (Management) Company Limited, Eternal Ethos Limited, Ocean Right Limited trading as Mei Ho Seafood Restaurant, Aztec International Company Limited, Power Elephant Environmental technology Limited and Man Siu Ling trading as Pro-works Computer Technology, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $39,017.5, $37,597.55, $30,231.87, $17,719.5, $17,025.47, $16,137.8, $12,859.02, $12,286.21, $10,464.79, $8,646.25, $7,350, $4,812.05 and $1,569.44, being mandatory contributions in arrears and surcharges payable.

     The Adjudicator also ordered the defendants, Well King Transportation Limited, Adrian Construction Limited formerly known as Adrian Engineering Limited and Pretty Garments (HK) Limited, to pay the MPFA the sums of $15,000, $5,000 and $5,000 respectively being the financial penalty imposed by the MPFA for failure to make MPF contributions for employees.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The Tribunal further ordered the respective defendants to pay $106, $90, $129, $160, $189, $139, $90, $180, $126, $96, $183, $60, $115, $90, $145, $79, $105 and $80, as the costs in respect of the claims.

     Wah Tai Farm Company Limited pleaded guilty previously at Kwun Tong Magistracy to 40 counts of failing to make MPF contributions on time and was fined $40,000.
