Eight employers ordered to pay MPF non-payment

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority

     The Mandatory Provident Fund Schemes Authority (MPFA) today (January 29) obtained two orders for payment of outstanding MPF contributions at about $333,000 against two employers in the District Court. Meanwhile, the MPFA pursued six claims in the Small Claims Tribunal for some $72,000 on behalf of 18 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgment against two employers, namely, Asia Intelligence (HK) Limited and Goldenwall Engineering Limited. The defendants were ordered to pay the MPFA the sum of $249,954.01 and $84,038.22, being mandatory contributions in arrears and surcharges payable to 175 and 25 employees of the defendants.

     Meanwhile, at the Tribunal's hearing today, six defendants, including Wong Kong Yiu Nigel trading as N K Wong & Co., Leung Chun Wa trading as United Company, Cheung Wing Foods Development Limited, Au Chi Yuen, Sanley Limted trading as Ban Chiu Hin Restaurant and East Asia (Giotto) Co Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $27,242.25, $16,668.93, $12,400.77, $10,080, $2,945.19 and $2,832.84, being mandatory contributions in arrears and surcharges payable.

     The Adjudicator also ordered the defendant, Au Chi Yuen to pay the MPFA the sum of $5,000 being financial penalty imposed by the MPFA for failure to make MPF contributions for employees.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants each to pay cost of $930. The Tribunal ordered the respective defendants to pay $110, $129, $129, $120, $109 and $85 as the costs in respect of the claims.
