The following is issued on behalf of the Mandatory Provident Fund Schemes Authority
The Mandatory Provident Fund Schemes Authority (MPFA) today (January 25) pursued seven claims in the Small Claims Tribunal for about $66,000 on behalf of eight employees, who were owed MPF contributions by their employers.
None of the seven defendants, David Paul Werner trading as Asia First Technology, Adrian Construction Limited formerly known as Adrian Engineering Limited, Capital Gain Holdings Limited formerly trading as Man Lee Restaurant, Good Huge Limited trading as Sunrise Seafood Restaurant, Deschamps Catering Company Limited, Yu Tak Ming Andy formerly trading as Kim Fat Restaurant and Leung Hing Chiu Chow Restaurant Company Limited, appeared. In their absence, the Adjudicator ordered them to pay the MPFA $28,417.64, $13,621.22, $12,892.50, $6,343.10, $3,051.22, $2,182.98 and $60.33, being mandatory contributions in arrears and surcharges payable.
The Adjudicator also ordered the defendant, Leung Hing Chiu Chow Restaurant Company Limited to pay the MPFA $10,000, being financial penalty imposed by the MPFA for failing to make MPF contributions for employees.
The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The Tribunal further ordered the respective defendants to pay costs of $169, $160, $60, $90, $80, $109, $125 and $60.
