Proprietor fined for violation of safety rules

     Lucky Engineering Company Limited was fined $45,000 at Eastern Magistrates' Court today (December 22) for violations of the Factories and Industrial Undertakings Ordinance and the Construction Sites (Safety) Regulations. The prosecution was launched by the Labour Department.

     The case involved a fatal accident on October 30 last year on a construction site at Happy Valley when a worker was electrocuted while installing floodlights at height.

     According to Sections 6A(2)(a) and 13(1) of the Factories and Industrial Undertakings Ordinance, the proprietor must provide a system of work that is, so far as is reasonably practicable, safe and without risks to health of the persons employed.  Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.

     In addition, according to Regulation 47(1) of the Construction Sites (Safety) Regulations, the contractor must take measures to prevent workmen from being endangered by live electric cables.   Any contractor who fails to do so is liable to a fine of $200,000.
