Three officers and two employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Three company officers and two employers were fined $81,000 at the Kwun Tong Magistracy today (August 4), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Mr Wong Hon Hung, Officer of Chiu Lee Transportation (Container) Co  Limited, was charged under section 7A(8) and section 44 of the ordinance, pleading guilty to 11 counts of failing to make MPF contributions for its employee within the prescribed time for the contribution period between August 2007 and June 2008. The defendant was fined $4,000 for each summons, totalling $44,000.

     Mr Lam Chi Wa, Officer of Everbright Logistics Limited was charged for offences under section 7A(8) and section 44 of the ordinance, and pleaded guilty to 30 counts of failing to make MPF contributions for its employee within the prescribed time for the contribution period between April and September 2005 and between November 2005 and October 2007. The defendant was fined a total of $30,000.

     Ms Leung Wing Hung, Officer of Duo Lai Beauty and Slimming Limited was charged under section 7(1) and section 44 of the ordinance and was fined $2,000 for failing to enrol an employee in an MPF scheme.

     Duo Lai Beauty and Slimming Limited was also charged under section 7(1) of the ordinance and was fined $2,000 for failing to enroll an employee in an MPF scheme.

     Lordin Apparel Limited pleaded guilty to an offence under section 7(1) of the ordinance and was fined $3,000 for the summons for failing to enrol an employee in an MPF scheme.

     The MPFA today pursued a claim in the Small Claims Tribunal for about $19,000 on behalf of an employee, who was owed MPF contributions by their employer.

     Chan Sin Chau formerly trading as Man Shing Fortune Barbecue did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $19,792.50,being mandatory contributions in arrears and surcharges payable.

     The amount awarded at the tribunal will be reimbursed to the employee¡¦s MPF account as soon as it is received by the MPFA. The tribunal ordered the defendant to pay costs of $478.

     Chan Sin Chau formerly trading as Man Shing Fortune Barbecue was previously fined a total of $18,000 on 12 counts of failing to make MPF contributions on time.
