Four employers ordered to pay MPF arrears

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (June 24) pursued four claims in the Small Claims Tribunal for some $90,000 on behalf of 22 employees, who were owed MPF contributions by their employers.

     At the tribunal's hearing today, a defendant, Chak Chun Ming formerly trading as Chak Ming Engineering Company, did not dispute the amount claimed. The adjudicator ordered it to pay the MPFA the sum of $8,893.91, being mandatory contributions in arrears and surcharges payable.

     The other three defendants, Waheungai Company Limited, Nuxd (Hong Kong) Limited and Learning Plus Co., Limited trading as Lime Education Centre, did not appear at today's hearing. In their absence, the adjudicator ordered them to pay the MPFA the sums of $37,661.22, $31,550 and $19,383.72, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the respective defendants to pay $80, $241, $110 and $185 as the costs in respect of the claims.

     Waheungai Company Limited pleaded guilty previously at Kwun Tong Magistrates' Courts to five counts of failing to make MPF contributions on time and was fined $12,000.
