New Concepts Foundation Limited was fined $28,000 at Kwun Tong Magistrates' Courts today (June 22) for violation of the Factories and Industrial Undertakings Ordinance. The prosecution was launched by the Labour Department.
The case involved a fatal accident on May 26, 2008, on a construction site at Yau Tong, when a pile suddenly collapsed while being cut and struck a worker.
According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor must provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risk to health of the person employed. Any proprietor who fails to do so is liable to a fine of $500,000 and imprisonment for six months.
According to Section 6A(2)(c) of the Factories and Industrial Undertakings Ordinance, the proprietor shall also provide the necessary information, instruction and supervision to ensure, so far as is reasonably practicable, the health and safety at work of the person employed. Any proprietor who fails to do so is also liable to a fine of $500,000 and imprisonment for six months.
