Company director and four employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     A company director and four employers were fined $70,500 at the Kwun Tong Magistracy today (June 2), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Chan Lap Yuen Lima, director of Modern Apex Arts Limited, was charged under section 7A(8) and section 44 of the ordinance, pleading guilty to nine counts of failing to make MPF contributions for employees within the prescribed time for the contribution periods between April and August 2008. The defendant was fined $1,000 for each summons, totalling $9,000.

     Modern Apex Arts Limited was also charged with offences under section 7A(8) of the ordinance. The defendant pleaded guilty to nine counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between April and August 2008. The defendant was fined $1,000 for each summons, totalling $9,000.

     Chiu Lee Transportation (Container) Co., Limited, was charged under section 7A(8) of the ordinance. The defendant pleaded guilty to 11 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between September 2006 and July 2007. The defendant was fined $4,000 for each summons, totalling $44,000.

     Brookwood Limited trading as Animal Medical Centre ¡V North Point,was charged for an offence under section 7A(8). The defendant pleaded guilty to 11 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between February and December 2007. The defendant was fined $500 for each summons, totalling $5,500.

     Connie Beauty & Slimming Centre Company Limited pleaded guilty to an offence under section 7(1). The defendant was fined $3,000 for failing to enrol an employee in an MPF scheme as required by the ordinance.

     Three employers were fined $12,000 at the Kwun Tong Magistracy yesterday, after being convicted of offences under the ordinance.

     Success Union Industrial Limited was charged under section 7A(8). The defendant pleaded guilty to eight counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between March and October 2008. The defendant was fined a total of $8,000.

     Keen Centre Limited trading as Long Shan Pharmaceutical pleaded guilty to an offence under section 7(1). The defendant was fined $3,000 for the summons for failing to enrol an employee in an MPF scheme as required by the ordinance.

     Gold Estate Agency Limited pleaded guilty to an offence under section 7(1). The defendant was fined $1,000 for the summons for failing to enrol an employee in an MPF scheme as required by the ordinance.

     The MPFA today also pursued 14 claims in the Small Claims Tribunal for about $115,000 on behalf of 40 employees, who were owed MPF contributions by their employers.

     The defendants, G's De Rochas (H.K.) Limited, Lam Siu Wai formerly trading as Wong Yip Cargo Service Co, Wah Tai Farm Company Limited, Universal Investment Enterprises Limited trading as Apple Snooker Club, Thunder House Electrical Appliance Limited, Siu Wai Tack and Wong Chi Hang Patrick formerly trading as Wing Lung Kai Restaurant, Automobile United Supreme Club Limited, Stephen Finley trading as Finley & Co., Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant, Wong Yun Leung formerly trading as Wah Yuen Noodle (translation), United Talent Investments Limited trading as Fresh & Health Bakery, Binger Marketing Work Company Limited, Shining Star Super Seafood Limited and Continent Enterprise Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA $26,180.50, $20,498.52, $19,435.56, $12,994.82, $8,400, $5,591.09, $5,546.12, $5,522.33, $4,557.75, $2,297.04, $1,443.75, $1,199.93, $850.54 and $624.89, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the respective defendants to pay costs of $165, $159, $120, $200, $96, $149, $135, $100, $80, $119, $70, $96, $115 and $76.

     Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant was previously fined $32,500 on 20 counts of failing to make MPF contributions on time.
