Nine employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (March 13) obtained orders in the District Court against two employers for payments of outstanding MPF contributions at about $230,000. The MPFA also pursued seven claims in the Small Claims Tribunal for about $160,000 on behalf of 28 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgment against Gold Sea Engineering Limited and New Comet Investment Limited trading as De-A Paper Products. The defendants were ordered to pay the MPFA $135,568.08 and 102,415.57 respectively, being mandatory contributions in arrears and surcharges payable to 37 and four employees.

     At the tribunal's hearing, four defendants, Spi Marketing Limited, Jat Management Limited, Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant and Solomon Communications Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $43,251, $32,908.40, $23,691.04 and $11,550, being mandatory contributions in arrears and surcharges payable.

     The other three defendants, Tsoi Mau Hung, Kong Kwok On & Fong Chun Hing trading as Wing Lun Construction Engineering Co, Bo Hing Construction Materials Co. Limited and King Deer (Hong Kong) Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $49,739.45, $767.42 and $276.98, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to each pay costs of $930. The tribunal ordered the respective defendants to pay costs of $170, $276, $160, $127, $260, $146 and $86.

     Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant was previously fined $32,500 at Kwun Tong Magistracy on 20 counts of failing to make MPF contributions on time.
