The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
The Mandatory Provident Fund Schemes Authority (MPFA) today (March 9) pursued 11 claims in the Small Claims Tribunal for about $122,000 on behalf of 36 employees, who were owed MPF contributions by their employers.
Apple Green Limited, formerly known as Uni-Pac International Real Estate Consultants Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $5,335.81, being mandatory contributions in arrears and surcharges payable.
The other 10 defendants, Huang Zhiting formerly trading as Sun Wui Tung Shipping Co, Chiu Lee Transportation (Container) Co. Limited, Design East (International) Limited, Top System Investments Limited, Pershing Company Limited, Energie Eyecare Limited, Cetrotek Holdings Limited, Rabbi Imran trading as Citimark, Lau Yiu Kwan formerly trading as Ming Cheong Fashion and Sunrise Health Promotion Centre Limited trading as Sunrise Elderly Home, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA $39,600.11, $34,375.12, $31,936.77, $3,367, $2,995.55, $2,250, $1,150, $780, $540 and $315, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The Adjudicator further ordered the respective defendants to pay costs of $96, $180, $186, $212, $116, $70, $85, $156, $140, $150 and $146.
Apple Green Limited formerly known as Uni-Pac International Real Estate Consultants Limited and Chiu Lee Transportation (Container) Co. Limited pleaded guilty previously at Kwun Tong Magistrates' Courts to an offence, failing to enrol an employee in MPF scheme as required by the Ordinance and to seven counts of failing to make MPF contributions on time respectively. They were fined $1,000 and $17,500 respectively.
