The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
The Mandatory Provident Fund Schemes Authority (MPFA) today (December 17) obtained two orders in the District Court against two employers for payment of outstanding MPF contributions at about $200,000.
The MPFA also pursued five claims in the Small Claims Tribunal for about $100,000 on behalf of 41 employees, who were owed MPF contributions by their employers.
The District Court today issued judgments against Yeung Sui Transportation Company Limited and Cheung Yin trading as Wai Cheong Transportation Co. The defendants were ordered to pay the MPFA $149,272.35 and $55,037.50, being mandatory contributions in arrears and surcharges payable to 25 and 17 employees respectively.
At the tribunal's hearing, the five defendants, Micro Motor Manufacturing Company Limited, Law Muk trading as Wing Tak Weaving Factory, Ip Kan Sum formerly trading as Good Luck Restaurant, Joyful Management & Security Co. Limited and Action Link Investment Limited trading as Sun Bo Seafood Restaurant, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $41,338.02, $31,092.27, $13,747.80, 12,053.90 and $7,818 respectively, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants each to pay costs of $630, while the tribunal ordered the respective defendants to pay costs of $332, $190, $160, $150 and $100.
Joyful Management & Security Co. Limited was previously fined $5,500 on two counts of failing to make MPF contributions on time.
