Sea Channel Limited was fined $72,000 at Kwun Tong Magistrates' Court today (August 7) for violation of the Factories and Industrial Undertakings Ordinance. The prosecution was launched by the Labour Department.
The case involved a fatal accident that occurred on January 10, 2008, at Cha Kwo Ling Public Cargo Working Area. A worker sustained a head injury and drowned after falling into the sea.
According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide and maintain a system of work that is safe and without risks to health for the persons employed. Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.
According to Regulation 4(1) of Factories and Industrial Undertakings (Cargo and Container Handling) Regulations, the proprietor shall ensure that provision for the rescue from drowning of persons employed is made and maintained. Any proprietor who fails to do so is liable to a fine of $50,000.
