Child Abduction and Custody (Parties to Convention) (Amendment) Order 2008 to be gazetted

    The Child Abduction and Custody (Parties to Convention) (Amendment) Order 2008 made by the Chief Executive under Section 4 of the Child Abduction and Custody Ordinance will be published in the Gazette this Friday (May 9).

    The Amendment Order adds Ukraine to the list of contracting states and territories in the Schedule to the Child Abduction and Custody (Parties to Convention) Order (Cap.512 sub. leg. A), to implement the Convention on the Civil Aspects of International Child Abduction between the Hong Kong Special Administrative Region (HKSAR) and Ukraine. The Central People's Government accepted Ukraine's accession to the Convention on behalf of the HKSAR in March 2008.

    A spokesman for the Labour and Welfare Bureau said that the Convention provided an effective mechanism for the swift return of children wrongfully removed from their place of habitual residence to another contracting state in violation of custodial rights. The Convention is now in force in 80 states.

    In accordance with the requirements of the Convention, the Amendment Order will come into operation on June 1, 2008.
